• Guangzhou Maritime Court (GZMC) Successfully Held the 2021 Training Class aiming for Enhancing Comprehensive Quality and Improving Capability to Perform Duties for Court Clerks

      In order to enhance the clerks’ comprehensive quality and improve their ability to perform duties, and the work in Law Enforcement Division can thereby be completed more efficiently, GZMC held a training class on Oct. 30, 2021. GZMC clerks took the class in full attendance. The class was introduced to the clerks by Head of Political Department, Qing Dong, who brought up specific requirements including enhancing one’s political stance, being firm in political conviction and dedicated to one’s work, as well as increasing incorruptible conscious. The class was taught by concentrated lectures. Based firmly on the actual situation of clerks’ working condition, we invited Head of Research Office, Xuewei Ni, Head of Discipline and Supervision Department, Xiaochun Wang, the leader of the financial group of General Office, Tong Peng, to give lectures about the requirements of general quality for clerks, rules and regulations about combating corruption and promoting clean government, and financial works in the court, etc. We also invited senior clerks from our court, Huifen Zeng and Haoyan Shen, to share their experiences of working as court clerks for years, and some case analysis. All attendees had learned the working contents and specific requirement one more time. The group had acquired deeper understanding about more specific details of different working contents in case-filing, trial and enforcement divisions.  
  • Legal Service Center of Water Traffic Safety Inaugurated

      The inauguration was held by Guangzhou Maritime Court (GZMC) and Jiangmen Maritime Safety Administration (MSA) on October 26, 2021. Liu Sibin, Vice President of GZMC, and Shao Guo, Director of Jiangmen MSA, signed the Memorandum of Cooperation on Legal Service of Water Traffic Safety. According to the memorandum, both sides will develop deeper cooperation in cultivating talents of maritime investigation, making lists of maritime accident investigation experts, and conducting maritime inquiry training, as well as online mediation, investigation and evidence collection, affirmation of ownership of ships, litigation preservation, etc. The foundation of this Center is another joint effort of maritime trial and law enforcement departments to provide better legal service. They have been working together constantly, taking full advantages of their separate expertise and resources. The Center will serve as a convenient point of contact for water traffic related corporations and practitioners to access legal public service and enhance legal consciousness so that disputes can be resolved rapidly before litigation, and social conflicts can be reduced. Liu says the opening of this Center has added a new channel for dispute resolution and has provided new opportunities and experience for the building of maritime legal service platforms that cover coastal and riverside regions in Guangdong. Lai Jiaoming, Deputy Secretary of Jiangmen Politics and Law Committee, describes this cooperation between maritime trial and law enforcement departments as "a living example of 'I do practical things for the masses'". He says "it puts the principles of 'high efficiency, quality and convenience' into practice and raises our awareness of serving the public."  
  • GZMC Completed a Preservation of Maritime Evidence during the National Day’s Holiday

      Recently, the case-filing division of GZMC received an application for preservation of maritime evidence on a Cyprus ship named M/V PANAMAX AUSTRASIA, due to a general average dispute. The claimant, as the domestic consignee of the cargo carried by the ship, was requested to contribute the loss caused by a grounding accident during the voyage by the ship owner. In order to preserve the evidence relevant to the accident, the claimant filed the application above.   After examining the materials, the case-filing division accepted the application and made an order to adopt measures for preservation of the maritime evidence on September 29, 2021. During the execution of the order, the ship owner stated that they needed time to prepare paperwork. Since the ship planed to depart after unloading the goods during the National Day’s holiday, the owner requested the court to check the evidence to be preserved before its departure. Considering that shipment delay will cause great loss, the staff of case-filing division decided to execute the preservation by giving up their National Day’s holiday. After communicating back and forth, the attorney of the ship owner submitted available evidence to GZMC. However, Clerk Wei Zheng and Xiaotong Zhu figured out that the evidence submitted was not satisfied to the preservation order. They declared the seriousness of the issue to the ship owner and instructed him to abide by the order. After communicating with the ship owner and his Britain lawyer by the attorney, the captain of the ship submitted the evidence met with the request of the preservation order in the next day.   Led by the vice president Jinbiao Deng, the case-filing judge group cautiously examined the evidence list and checked the original files as well as the case description. After hours of examination, the evidence preservation was completed. GZMC connected with Dongguan Maritime Department to release the ship. In the end, GZMC succeeded in the proceedings of evidence gathering, examination and releasing before the scheduled departure time of the ship, which avoided potential great loss to the foreign ship owner.  
  • GZMC Released a Ship during National Day’s Holiday

      On October 2nd, 2021, with assistance of Shenzhen Tribunal, Zhanjiang Tribunal of GZMC had completed the mission of releasing M/V CSSC YUAN JING during the National Day’s holiday.   In the evening of September 28th, Qingdao Bohai Agricultural Development Co., Ltd, stating itself as the holder of original bill of lading, suffering severe damage to and shortage of soybean cargo, applied for the arrest of M/V CSSC YUAN JING and requested the shipowner or the bareboat charterer of the ship to provide 65 million CNY as security. After careful examination, Judge Deng Feifei and Clerk Li Boman of Zhanjiang Tribunal filed the case immediately and finished related paperwork on the same day night. Early in the next morning, Deng and Clerk Zheng Liping notified maritime safety administration, immigration inspection, and marine shipping agency. In the evening of September 30th, the maritime claimant submitted another application for decreasing the amount of security to 30 million CNY. The request had been approved by Zhanjiang Tribunal and the ruling was sent to the claimant and respondent on the very same day night.   On October 1st, the respondent notified Judge Deng it would like to provide security, with the type being guarantee issued by Ping An Insurance company, Shenzhen branch. In order to shorten the guarantee mailing time and to speed up the ship’s release, Deng suggested the respondent to submit the original guarantee files to Shenzhen Tribunal for review. On October 2nd, Judge Lin Yiyi of Shenzhen Tribunal, received the orginal guarantee from the insurer, sent through express mailing from the third party. Lin did an inquiry into the insurance company’s mailing process which included ordering, sending the file and delivery. In order to ensure the source and authenticity of the guarantee, writing notes from the delivery man and video record from the transactor of the insurance company were also gathered as evidence. After confirming GZMC had received the original guarantee, Zhanjiang Tribunal rendered a ruling to release the ship immediately.

  • Resolve the humanitarian crisis of abandoned crew on a Greek Vessel, Show the professional and efficient international image of Chinese maritime justice

      On July 26, 2021, Chen Chao, President of Guangzhou Maritime Court, received a thanks letter from the Captain of a Greek ship on behalf of 15 foreign crew members through his lawyer. Here the Captain said, “Your esteemed hard work and efforts on the subject matter indeed renders hope that we firmly believe our legitimate rights can be effectively protected by the Chinese courts. We are thankful to your judges for their work and efforts in handling matters related to our claims with professionalism, high efficiency, innovation and heart of justice.”   So you may wonder what exactly happened. Let me review the case. On April 16, 2021, on the application of LOTUS OCEAN TRANSPORTATION (HK) LIMITED due to a charter-party dispute, Guangzhou Maritime Court arrested a Greek ship ANGELIC POWER, owned by a Liberian enterprise named ANGELIKI DYNAMIS INVESTMENT CORPORATION, who was ordered to provide corresponding security within 30 days at Guangzhou Port. Instead of receiving the requested security from the Shipowner, the Court received a request for help from the Captain of the ship, saying that the crew was at the end of their fuel, food, freshwater supply, and their survival was into great difficulty. The ship would be abandoned, and all the crew members needed repatriation as soon as possible.   The maritime claimant is a Hong Kong registered company, while the Shipowner is a Liberian enterprise, the flag state was Greece, and the crew members were Filipinos and Greeks. No wonder this case attracted international community’s attention quickly at the very start. The Consulate of Greece in China, the Consulate of China in Greece, and Foreign Affairs Office, the People’s Government of Guangdong Province kept close contacts and communication over this case.    We were on the verge of a humanitarian crisis and a real safety issue. By overcoming the complex factors including the COVID-19 pandemic and diplomatic affairs, GZMC had coordinated efforts with all relative parties at a diplomatic level and adopted a series of measures to resolve the survival dilemma faced by the crew and the ship.   Firstly, the Court urged the Shipowner to perform his management duty through the captain and diplomatic channels, making it clearly understood that if within the time limit the Shipowner failed to do so, a third party would be entrusted to manage the ship. The Greek government was also urged to assume the relevant obligations as the flag state. Regrettably, the Shipowner did not resume management within the time limit. So, secondly, GZMC provided 70 tons emergency fuel on May 15, 2021 and a batch of daily supplies and common medicines soon afterwards in time, which resolved the safety risks and humanitarian crisis caused by abandoning ship management, and created favorable conditions for the follow-up work. Subsequently, GZMC initiated the third-party escrow process and randomly selected a third-party escrow company in accordance with the law, and then notified the Captain to accept the escrow company’s instructions and management, and the escrow company will regularly supply fuel and food to the ship.   After solving the basic survival needs of the ship and crew, then there was communication and coordination issue in front of us.   To speed up efficiency, GZMC established a Crisis Action WeChat Group with foreign affairs office, maritime safety administration and port authority to communicate and coordinate efforts. Under the coordination of the Court, the third-party escrow company, Guangzhou Port Authority, Guangdong Maritime Safety Administration and Guangzhou Maritime Safety Administration had reached consensus on crew repatriation arrangements, ship maintenance work, and typhoon prevention safety management. Moreover, to ensure the ship safety, the court arranged 4 professional repairers who were also seafarers to board the ship to inspect machinery and to perform necessary maintenance in accordance with epidemic prevention requirements.   In order to speed up ship takeover, with the support of Foreign Affairs Office and the People’s Government of Guangdong Province, GZMC urged the flag state, Greece, to fulfill its responsibilities towards the right of seafarers to be repatriated under Maritime Labor Convention (MLC). We were encouraged by the moves taken by the relative Greek government departments to agree in arranging for repatriation of the crew and covering such expense, to confirm that the seafarers dispatched by the third-party escrow company could board the ship without the need to endorsing their certificates. So far, the takeover of the ship had been successfully completed. As the second batch of 13 Filipino crew members and 2 Greek crew members headed for home from Guangzhou Baiyun International Airport respectively On July 22, together with the first batch of 7 Greek crew members being repatriated on April 29, the humanitarian crisis caused by crew abandonment of ANGELIC POWER had been successfully resolved.   And then there was the case filing issue of unpaid wages claims, brought by 15 crew members against the Shipowner in June, which happened to be a difficult time in Guangzhou which saw an uptick in Covid-19 cases. Due to Covid-19 pandemic control policies in Guangzhou, it was impossible for the crew to go ashore. Because of imminent repatriation of the crew, the formalities of notarization and certification needed to be urgently handled. GZMC offered to provide the 15 foreign crew members with online case filing services through China Mobile Mini Court pursuant to Several Provisions of the Supreme People's Court on Providing Online Case Filing Services for Cross-border Litigants, which had just come into force as of February 3, 2021. GZMC conducted authentication first. After passing identity authentication, the crew members entrusted two Chinese mainland lawyers to represent them in the proceedings, and they applied for online video witness.  As witnessed by the judge via video, the 15 foreign crew members and the entrusted lawyers signed the relevant documents on entrustment of agency, and were not required to go through the formalities of notarization, certification, forwarding, etc. After online video witness, the entrusted lawyers may carry out other matters on behalf of the crew members. Our purpose has been always providing Chinese and foreign litigants with equal convenience and efficiency of case filing services, and in this case, we are proud to say the purpose had been achieved.   At the 108th session of the Legal Committee of the International Maritime Organization (IMO) held on July 26 this year, the Greek delegation expressed its gratitude to the parties involved  for their smooth cooperation in bringing the abandonment cases to successful conclusion under very challenging circumstances.   Since the beginning of the security crisis caused by the abandonment of ship management and the humanitarian crisis caused by abandonment of crew members by foreign shipowner, GZMC had been working around the clock at all levels to find solutions. Thanks to and under the cooperation of all parties involved, the crisis had been properly resolved at last. The handling of the case not only increases the international influence of Chinese maritime justice, it also shows the world the professional and efficient image of Chinese maritime judges. The case sets a model for handling abandonment of foreign seafarers efficiently and successfully. It is also a successful example of China taking maritime judicial measures to protect the rights and interests of foreign seafarers during the pandemic.   Currently, we are pressing ahead with the ship auction procedure, and hearing the disputes over unpaid wages justly and efficiently.    
  • A case of GZMC was selected as a national typical case of maritime trial by the Supreme People's Court in 2020

    On August 16, 2021, the Supreme People’s Court issued the 2020 National Maritime Trial Typical Cases. Cases of Disputes on Liability for Marine Personal Injury between Fan XX, Guo XX, Huang XX, Zhou XX, and Luo XX tried by the Zhuhai Court of GZMC was selected. The collegiate panel to hear the case is the presiding judge Zhang Le, the judge Yan Hui, and the Macau people's assessor Ling Junlin. The defendant in this case is a Macau citizen. After the case was filed, facing the problem of serving the litigation documents to the Macau citizens, GZMC successfully resolved the service issues of many Macau parties with the help of the cooperation platform with the Zhuhai Hong Kong and Macau Mobile Fishermen Association.  Affected by COVID-19, one of the 89-year-old defendants was unable to complete the authorization procedures through the mainland notarization or the court interview. With the help of the case authorization witness platform developed by the Guangzhou Intermediate People's Court, GZMC successfully completed the first case of cross-border authorization witness involving a Macau citizen. Taking into account the fact that the case involved Macau, Hong Kong and Macau mobile fishing vessel operation factors, Macau law needs to be applied in the trial of the case, and Macau people's juror is selected as member of the collegiate panel to carry out mediation work in conjunction with the Zhuhai, Hong Kong and Macau Mobile Fishermen's Association. In the end, the mediation was successful, and GZMC issued a civil mediation statement for confirmation. The defendant has fulfilled all obligations on schedule. The settlement of this case is a successful practice of GZMC 's joint efforts to promote a diversified settlement mechanism for disputes involving mobile fishermen in Hong Kong and Macau. Since 2018, while ensuring the regular participation of Hong Kong and Macau jurors in trials, GZMC has continuously explored and improved the way for Hong Kong and Macau jurors to participate in trials, and promoted the convergence of legal rules and mechanisms between Guangdong, Hong Kong and Macau. GZMC also signed a cooperation agreement with the Zhuhai Hong Kong and Macau Mobile Fishermen Association to give full play to the advantages of the Zhuhai Hong Kong and Macau Floating Fishermen Association, to fully implement the "online" and "offline" mediation model for disputes involving Hong Kong and Macau mobile fishermen. Taking "One-stop" settlement to resolve disputes involving mobile fishermen in Hong Kong and Macau, and such disputes all have been properly resolved.

Tao Kaiyuan fully affirmed the positive contributions made by the research bases of No.4 Civil Division of the Supreme People's Court to the foreign-related commercial and maritime trial work of the People's Court and the construction of the rule of law in China in recent years. She emphasized that to strengthen the construction of research bases, we should improve our political standing and use Xi Jinping's thought of rule of law to guide the work of research bases; we should adhere to serving the overall situation and provide strong legal protection for major national strategies; we should play the role of think tanks and provide intellectual support for the deep integration of legal theory and judicial practice; and we should broaden our international horizons and contribute Chinese legal wisdom to the reform of the global governance system.  
  • Vice President Liu Sibin Visited Ningbo Maritime Court

    Liu Sibin, Vice President of Guangzhou Maritime Court, led a team of three people to visit Ningbo Maritime Court On July 23, 2021. Li Feng, Vice President of NBMC, Wu Shengshun,  member of the Judicial Committee, and Zhang Huagang, director of research Office of NBMC extended a warm welcome to Liu's visit. NBMC introduced, The Higher People's Court of Zhejiang Province appointed NBMC to accept and hear a traffic accident case. NBMC has officially initiated the process of specialized jurisdiction over maritime criminal cases. Up to now, NBMC has heard 33 criminal cases. The two sides exchanged views and discussed issues related to maritime criminal cases. The research group of GZMC pointed out that NBMC, as the first maritime court to hear criminal cases pilot court, has accumulated a lot of useful working experience and practices after several years of practice and exploration. In the next step, GZMC will promote the pilot work of maritime criminal trial of the court as soon as possible, and actively create a new situation of "three trials in one" in maritime trial of the court.
